CIDCO Auction Of A CRZ Plot In Navi Mumbai

The largest plot in the CIDCO e auction, measuring 6.21 acres, falls under CRZ -1A and CRZ-II.

The National Green Tribunal (NGT) has stayed the auction of the 25,138.86 sq m Seawoods tender plot 2A with immediate effect. The plot, which is adjacent to the NRI complex in Seawoods in Navi Mumbai, is part of the CRZ-1A and CRZ-II zones. The Western Zonal Bench of the NGT, after hearing petitions from two groups, directed CIDCO to halt the tender process.

According to reports, the Bench has given CIDCO three weeks to file a response, and the hearing is set to resume on September 28, 2022.

The petitioners have asked the court to designate plot 2A as open space, as mentioned in the NMMC Development Plan. In addition to opposing the e-auction.

Previously, environmental activists in Maharashtra had written to the chief minister, expressing their concern about the tender auction of a large CRZ plot. The plot, which measures 25,138.86 sq m and is adjacent to the NRI complex in Seawoods, is part of the CRZ-1A and CRZ-II zones. The hovercraft jetty and flamingo zones such as TS Chanakya wetlands and DPS lake are nearby.

The Seawoods tender plot 2A, which encompasses sectors 54, 56, and 58. Has an FSI of 1.5 and has the potential to fetch more than Rs 300 crore in the auction. The Maharashtra chief minister’s office has directed the Ministry of Urban Development and the Environment Ministry to investigate the complaint.

 

CIDCO Auction Of A CRZ : CIDCO has cited a special instruction regarding the 2A plot at Nerul in its defence, stating that:

 

  • There are no limitations on the sale or auction of CRZ-affected plots.
  • According to the CZMP of 2011, which was approve in 2019. The plot is part of CRZ-IA and CRZ-II, as indicated in the marketing drawing.
  • According to the CRZ provisions, plot 2A is on the landward side of the existing road and contains no mangroves.
  • The CRZ-IA area within plot 2A is in the mangrove buffer zone, not the mangrove zone.
  • According to the court order and CRZ notification. Statutory permissions from the competent authority are require for development in CRZ areas.

CIDCO also stated that the allottee / lessee would be responsible for obtaining all necessary permissions from competent authorities for development in the CRZ affected area. Tender plot 2A is one of 16 plots put up for auction by CIDCO. Plot 2A is the auction’s largest land parcel. With a base rate of around Rs 1.17 lakh per sq metre and an EMD of around Rs 29.49 crore. The tender process was complete on August 18, 2022, with the results to be announce on August 22, 2022.
