Maharashtra: These Properties Might No Longer Be Subject To Taxes

The non-agricultural (NA) tax imposed on housing societies, apartments, and plotted developments is something that the state housing federation in Maharashtra wants the state government to get rid of. The collection of the non-agricultural (NA) tax in urban areas had been halted by the Revenue Department of the previous Maha Vikas Aghadi (MVA) administration. The federation members are hoping that during the current assembly session. The temporary suspension of the NA tax will be change to its removal.

 

What does Non-Agricultural (NA) Tax mean?

Using agricultural land for non-agricultural activities is subject to the non-agricultural (NA) tax. All properties, including housing societies, plots, retail establishments, and industrial sheds, that are not consider to be in “gaothan areas” as define by the Maharashtra Land Revenue Code, 1960, are subject to the NA tax. Every five to ten years, it is update.

According to government data, Maharashtra has a total of about two lakh housing societies & apartments. Only 10,000–15,000 people are cover by gaothan and are therefore free from the NA tax.

 

PIL filed against non-agricultural (NA) tax collection

The MVA government announced a suspension on the collection of the NA tax after Bombay High Court (HC) attorney Satya Muley assisted the Maharashtra Cooperative Housing Federation in filing a Public Interest Litigation (PIL) against the NA law.

The HC still has the PIL. The demands of the populace go beyond a suspension of NA tax collection. As such land has been permanently turn into residential sites. They want urban areas to be permanently exclude from the application of the NA tax. The State should make a pro-position announcement while the assembly is in session. If not, the HC will decide how to handle the situation.
